Mayor Dunbar opened the meeting promptly at 8. All Council members were present except for Mr. Laymon who had been excused.

Police Chief Garon said it was nice to have peace and quiet once again after an almost normal, but busy summer. Police activities during September were routine except the sign forbidding vehicles on the beach was run down by a vehicle on the beach. It as been replaced Lately, though, there have been several vehicles on the beach and the police ask residents to report them immediately.

The Fire Company responded to four fire calls, had four drills and one regularly scheduled business meeting during September, as well as hosting a meeting of the Northern Ocean County Chiefs Association and participating in a Fire Prevention Fair.

Twelve new permits and seven updates were issued by the Construction department, all for private ownership, mostly alterations, additions, one demolition and one new building.

CFO Crelin has asked all departments to turn in their budgets by November 12th so the Finance Committee can begin to prepare for 2000. . . Contributions to the Marine Patrol totaled $7800 as of this date. . . . All but three items have been paid from the Tax Sale List, and these will most likely be paid before the October 29th sale. Council does have an option to bid on these properties if the town needs them for some reason, but does not really want to get involved with owners and taxes.

The following Resolutions were passed:

a. Award the contract for the purchase of a new police car to Winner Ford of Cherry Hill, a 2000 Crown Victoria Police Interceptor for $20,349.33;

b. Provide approval of the application for payment number one for the bulkhead projects at Old Bridge Street and Bergen Avenue;

c. Consider the appointment of a special counsel (John J. DeVincens, Esq.) for pending litigation regarding violation and stop work notices concerning development of premises at 1225 Ocean Avenue. Borough Counsel has recused himself to avoid conflict of interest;

d. Consider the appointment of a 2000 Census Municipal Complete Count committee. The 22nd Decennial Census will be taken in 2000, and in order for the Borough to insure proper political representation to ensure it receives its fair share of federal and state funding, and provide accurate statistical information ensuring a detailed database for planning purposes for the next ten years, and in order to ensure the accuracy of Census 2000 in the Borough, Municipal Clerk Irene H. Ryan and Deputy Clerk, Nancy Klumb have been appointed to serve on the Complete Count Committee.

The Mayor urges all residents to respond to the census letters. It is vitally important for the Borough to be properly represented.

e. Oppose Senate Bill S-632S-ca and Assembly Bill A-112AcaAa "Home-Based Business Promotion Act." Mantoloking "vigorously objects to this proposed State mandate that would disrupt the character and integrity of local residential zoning standards and totally disenfranchise citizens, property owners and taxpayers from their lawful right to participate in the local zoning process which is part of New Jersey's great heritage of local autonomy. . . Present State law already permits local municipalities to set their own standards for home-based businesses and occupations, based upon the unique local character of a community and its residential neighborhoods. . .residents would be stripped of any influence on the character, quality and integrity of local residential neighborhoods." Councilman Gillingham said he isn‚t against home-based businesses, but is opposed to involvement of and by the State.

Ordinance # 410 was introduced and passed by title only. This ordinance repeals Ordinances #376 and #401 which appropriated the sum of $66,000 to replace the bulkheads at Old Bridge Street and Bergen Avenue. Due to unforeseen site conditions and increases in the scope of the work, the cost has increased by $11,800.

Councilman Jones reported the Beach Walk saw the dunes in good shape and the beach seems to be in better shape than in the summer. The recent storms deposited lots of sand offshore. The grass planted last year is an enigma. Some grew, some did not. Some residents watered, some did not. The drought did not effect all the grass in a uniform pattern. The conclusion might be some grass plants were immature and just couldn‚t handle the conditions. Or, residents allowed the plants to dry out. Anyway, dune grass will be distributed Saturday, November 6th from 8 to noon. Keep it moist until it is planted.

Councilman Husted reported that Mantoloking hosted a luncheon meeting For the Communities on the Reach from Manasquan to Barnegat Inlets to provide current information and status of the projected beach renourishment for the above reach. Bernie Moore of the NJDEP and Administrator of Division of Engineering and Construction reported the renourishment program was on track and the funding for the recognizance study had been approved. He thought the engineering study by the Corps of Engineers could be finished and renourishment could start by 2002. Bill Crelin provided detailed information about setting aside funds now to be prepared to provide the monies needed for the project. It is absolutely mandatory to have the funds in place since the feds will not put up any until the local communities have paid.

If you see telephone wires fraying or street lights out, it is best to call the companies. They may respond to public pressure, according to Councilman Gillingham.

Council has accepted the design of the Historical Committee's Borough Flag, Councilman Nebel said. It is a white rectangular field with a black Borough seal and a red M on the sail. (The seal is on the 1999 Directory). The flag will be flown at the 150th celebration of Ocean County in November, 2000.

THE REPLACEMENT OF MANTOLOKING BRIDGE INFORMATION CENTER, will be held in the Borough Hall Meeting Room on Monday November 8th from 4 to 7pm.

ATTENTION ALL REGISTERED VOTERS! On Election Day, November 2nd there will be a State question for the approval of the 1999 Bridge Bond funds. This fund includes the money for the replacement of our Mantoloking Bridge. Please vote "Yes" for the approval of this expenditure or we may not be getting a new bridge in the near future.

Council went into closed session to discuss contractual matters, possible and/or pending litigation and to receive advice of counsel.
