NOTICE TO ALL PROPERTY OWNERS
The Borough Engineer and Superintendent have discovered that several homeowners have
illegally connected their cellar sump pumps to the Borough's sanitary sewer collection
system. The owners have been notified and will be subjected to prosecution in the
Municipal Court, if the violations are not immediately corrected. Ordinance #191
prohibits the discharge of sump pumps into the sanitary sewer. Violators are subject
to fines of up to $500.00 per day!
These illegal connections are especially burdensome to all property owners because
the sump pump discharge causes a significant increase in the Borough's cost for treatment
of its waste water.
The Borough's investigation (via video) is ongoing. All homeowners are now advised
that they must immediately disconnect any sump pump discharge from their sewerage
house lateral. Sump pump discharge must be directed
in an appropriate manner to the street and the storm water system. Mayor Roman has
announced that violations which are discovered later than two (2) weeks following
publication of this notice will be prosecuted.
Please be guided accordingly.

Residents living next to and near Lyman Street are bearing the full brunt of the
recent Council retraction of surfing regulations. The Police hear the complaints
and act upon them, yet as soon as they are
out of sight, the surfers continue to abuse their privileges. They disrobe completely,
moon passersby, use disgraceful language, eat, drink, discard cans and cups, play
music loudly, climb over beach fencing, trespass on private property, usurp the platforms,
are confrontational and blatantly rude to residents- "if I don't move, whadiya
gonna do, ya rich f---ing b---"? Carol Leone, Dick Thomas, Marion Mauro and
Margaret Belmont spoke at length to Council. It has
become "an open lockerroom, an absolute disgrace."
There were complaints about the dog problem, of people coming to Mantoloking from
all over the area to run their dogs on the beach, on the dunes, and not cleaning
up after them. Council has addressed this problem and passed Ordinance #395, explained
later in this issue.
COUNCIL MEETING, JUNE 15, 1998
Mayor Roman opened the meeting at 8:45 pm. Councilwoman Colie had been excused to
accompany her husband Runnie to his 60th Dartmouth College reunion.
The Police have been advised on ordinance violations and have been instructed to
issue summonses on any offense, not just warnings. A summons mandates a court appearance
and/or a fine. Special police are now on beach duty. The Mantoloking Police Boat
is in the water and patrolling and they, too, may now issue "traffic tickets"
upon observing
marine violations.
Please call police if anything suspicious is observed. If citizens observe ordinance
violations they may sign complaints. The police cannot sign them if they do not themselves
observe the violation.
Please lock your homes and cars when going to the beach. Don't leave pocketbooks
"just inside"‚ the door of your home.
During May, the Fire Company responded to 17 fire calls, had three training drills
and the regularly scheduled business meeting. Of that total, three were lightning
strikes, seven were alarms sounding, two were gas leaks, two were basement floodings
and one was an electric hazard flooding, one electric short and one CO alarm.
Fire Chief Popaca stated the new alarm system has been held up because the emergency
generator needed adjustment, but that is to be fixed today and the siren will not
blare between 10 pm and 7 am.
Superintendent Heckman completed all accesses to the beach, cleared the Bergen Avenue
beach of all accumulated debris, marked out sewer lines and laterals for the water
company project along Bay, Princeton and
Arnold Avenues as well as those at individual properties on Lagoon Lane, Mathis Place,
Ocean and East Avenues and Barnegat Lane.
The construction official reported there were thirteen permits issued during May,
of which five were residential, consisting of three alterations, one addition and
one new building. There were seven alteration permits issued for non-residential
usage and one for a demolition.
Chief Financial Officer Crelin stated Beach Badge sales began on June 9th, that bad
weather has reduced sales and we are 38% below last year, but expect to have sales
pick up once the weather improves.
Tax delinquencies for 1998 have been reduced substantially, but 1997 still has holdouts.
Ordinance #394 providing for the acceptance of the donation of Lot 5.01, Block 24
to the Borough of Mantoloking upon the proviso that it remain in an entirely naturally
vegetated state was passed. This property is known as 1030 Ocean Avenue, and could
also be 1025 Barnegat Lane. But, no matter, it will remain a home to squirrels and
rabbits, song birds, foxes and other critters, and lots and lots of poison ivy.
Councilman Dunbar has received many queries about the new schedule of garbage and
recycling pickup. Route #1 is Tuesday and Friday, and Route #2 is Wednesday and Saturday.
Route #2 consists of all properties west of Ocean Avenue and north of Herbert Street
to the Bay Head line. All other properties are on Route #1.
Recyclables are picked up on Mondays for Route #1, and Thursdays for Route #2. All
paper products, ie, newspapers, junk mail, writing or copy paper, magazines, catalogues
are to be placed at curbside, bundled and tied, and placed out no earlier than the
night before pickup. These are now picked up weekly, along with bottles and cans.

In new business, five resolutions were passed:
1) A resolution by the Mayor and Council of the Borough of Mantoloking
providing for execution of interlocal agreement with the Borough of
Point Pleasant Beach for lease of mobile data terminals for use by the
police department. This will give the Mantoloking police department
access to relevant police information from the State of New Jersey;
2) A resolution providing for adoption of a public employee deferred
compensation plan: Employee Deferred Compensation Plan under Section 457
of the Internal Revenue Code, 02-S.D.-Equitable -021695 as offered by
Equitable Life Assurance Society of the United States. This will allow
Borough employees to put away some of their salary as tax deferred. It
is not mandatory and it is not matched by the Borough;
3) A resolution approving the applications of Richard R. Gilman and
Joseph M. Intile, Sr. to become members of the Mantoloking Fire
Company. Mr. Gilman will be a fireman and Mr. Intile will become a fire
policeman;
4) A resolution to consider the request of one resident for an
extension of time for compliance on the matter of an illegal sump pump
discharging into the sanitary sewer system; and,
5) A resolution to consider the 1998 New Jersey Department of
Transportation Paving Grant to repave Channel Lane. It has been noted
by the Borough engineers that the roadway surface of Channel Lane is
poor and in need of resurfacing.
Ordinance #395, amending Ordinance #233, repealing Ordinance #362 and providing for
the PROHIBITION of dogs (and other animals) from Borough-owned beaches and access
ramps (walkways) from June 15th to September 15th was passed by title only. Council
has had to deal with daily complaints from beachfront owners about truckloads of
dogs coming from Brick (dogs are not allowed on their beaches), Bay Head (dogs are
not allowed on their beaches), Point Pleasant Beach (dogs are not allowed on their
beaches), Point Pleasant (dogs like to run on our beaches) and other points in near
New Jersey. Unfortunately, those irresponsible dog owners have ruined the privilege
of dogs-on-the-beach
for non-beachfront residents of Mantoloking and others who abide by the rules.
Article IV-Rules and Regulations, sub-article 1(f) of Ordinance 233 is hereby amended
by the addition of the following:
" further, no dogs or other animals shall be permitted, at any time, upon Borough
owned ocean beaches and accessways (walkways) within the Borough of Mantoloking from
June 15th to September 15th, inclusive."
Ordinance #396 was introduced, providing for boating regulation in tidal waters adjacent
to the Borough of Mantoloking, pursuant to Chapter 7 of Title 12 of the New Jersey
Statutes and regulations issued there under.
To protect the public interest and safety, a marine patrol of tidal waters of Mantoloking
is established to enforce New Jersey statutes and regulations re boating; and NJSA
12:7-79 provides for joint enforcement by the Department of Law and Public Safety
and by municipalities of all New Jersey statutes and regulations governing the operation
and
equipment of boats; and NJSA 12:7-34.53 permits municipalities to adopt ordinances
relating to boats. . .
The ordinance provides for power boat noise control, numbering and registration,
display of numbers, limitations on the operation of personal watercraft, responsibilities
of persons operating watercraft, personal flotation devices, docking, mooring, anchoring
of power boats, careless operation of boats, obeying law enforcement officers, etc.--the
whole nine yards. A special meeting will be held at Borough Hall on Tuesday, June
30th at
8:00 pm to talk about Ordinances 395 and 396.
Councilmen Husted and Jones reported the damaged have been repaired and most owners
have complied with sand fencing their dunes. . . .FEMA will meet sometime after July
4th to consider changing Oceanfront zoning to
V-zone which will require new construction to be on pilings, thus flow through. .
. .Flood insurance rates will be affected in the future, so if you sell your house,
transfer the flood insurance to the new owner.
With V-zone designation, existing houses without pilings, etc. will cost more to
insure.
Please read and act upon the enclosed letter from the Borough. It is imperative to
have the Corps of Engineers continue the beach restoration projects.
Handicap ramps to be installed at Bay Avenue and Downer Avenue will be delayed until
the fall. There is not enough time to have them in place for this summer.
The next regular Council meeting will be Monday, July 20th at 8:00 pm
Council went into closed session to discuss and to receive advice from counsel on
matters of litigation and contract negotiations.
The meeting was adjourned at 9:15 pm.
